PRE-TRIAL SERVICES

Defendants are assigned to pre-trial supervision at the courts discretion. Supervision may consist of any of the following: daily contact, weekly contact, electronic home monitoring, GPS tracking and random or set substance abuse monitoring. The purpose of any monitoring is to ensure compliance with bond conditions set by the Court, and to reduce the failure to appear rate. Defendants are required to pay monthly supervision costs while assigned to the Pre-trial Services program.

COMMUNITY CUSTODY PROGRAM

This program is dedicated to sentenced non-violent misdemeanor and low-level felony offenders. The objective of the program is to reduce the amount of jail time served by converting some of the time to Electronic Home Monitoring. Offenders may be direct sentenced to the program under a plea agreement, or screened for participation after 2/3 of their sentence has been completed (Note: this process is only used when the jail population is close to maximum capacity). Offenders must have a local residence and be able to pay program costs in order to participate. All offenders assigned to this program must pay a $50.00 set-up fee, and a daily fee based on the type of supervision ordered by the Court.

DAY REPORTING PROGRAM/DRC LITE

This program is a 90-day intensive program designed for DUI offenders with 2 to 5 convictions for DUI or DWAI. (DRC Lite is 1st time offenders with BAC over .199) During the program, offenders are placed on a home Sobrietor unit for 90-days, and are required to attend substance abuse treatment classes 3 times per week at the center. Within 10 days after completing of the initial 90-day program, offenders must transition to the remainder of their court ordered treatment and monitoring at an authorized treatment center. During this phase, offenders are tracked each month to ensure they are continuing to attend treatment and complying with monitoring requirements. This requirement remains in effect until their case is closed. Offenders receive a reduced jail sentence for participating in this program. Offenders in this program are required to pay for a portion of their program costs based on a sliding-fee-scale.

WORK RELEASE INFORMATION

The purpose of the Work Release Program is to allow non-violent misdemeanor and low-level felony offenders to serve their jail time in a manner that is productive for the offender and the community. In this program, offenders are allowed to leave the jail to go to work for up to 12 hours each day, 6 days per week. All time spent away from the jail must be pre-approved based on verification of schedules by the employer. Random job site checks are conducted to ensure compliance with program rules.  Offenders are required to pay for a portion of their incarceration based on a sliding-fee-scale. This helps to reduce the expense of housing offenders, and ultimately reduce the burden on the taxpayers. 

You must telephone the Work Release Coordinator to make an appointment for a Work Release Interview. Call the Coordinator at 375-2342 Ext 5, Monday through Thursday between 8:00 a.m. and 5:00 p.m. This interview must occur at least 48 hours prior to the start of your sentence. You may be denied Work Release if you fail to do this.

Bring your paperwork from the Court. This should be your Sentencing Order or Mittimus (yellow or pink copy from the judge).

You must have been sentenced to at least 10 days to be eligible for Work Release.

The Work Release Coordinator retains the discretion to determine whether the inmate will actually be placed in the Work Release Program. However, the Judge must request Work Release on the Sentencing Order or Mittimus. The Work Release Coordinator will not place an individual on Work Release if that person is precluded from doing so by the Court.

The La Plata County Work Release Program is a very strict program and requires stringent criteria be met to remain in the program. Not all applicants are accepted and it is not automatic.
